Acceptance of Terms

By downloading, installing, or using Yemmi, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

We may update these Terms from time to time. Your continued use of Yemmi after changes constitutes acceptance of the updated Terms.

These Terms constitute a legally binding agreement between you and Pluto Rock LLC ("Company", "we", "us", or "our").

If you download Yemmi from the Apple App Store, Apple's Standard Licensed Application End User License Agreement also applies. These Terms supplement that standard agreement and do not reduce any rights Apple or you may have under it.

Description of Service

Yemmi is a mobile application that:

• Scans food product packaging and barcodes
• Provides AI-generated nutritional analysis and ingredient information
• Offers personalized insights based on optional user preferences
• Suggests alternative products that may align with your goals

Yemmi is designed for educational purposes to help you understand what's in your food. It is NOT designed to:

• Diagnose, treat, cure, or prevent any disease
• Replace professional nutritional or medical advice
• Serve as the sole basis for dietary decisions

AI-Generated Content Limitations

Yemmi uses artificial intelligence (AI) to analyze products and generate recommendations.

When you use scan, meal photo, ingredient analysis, or personalized insight features, you authorize Yemmi to transmit relevant photos, barcodes, product text, ingredient labels, nutrition facts, meal notes, and limited profile context you provided to third-party AI providers, including OpenAI, so they can process your request and return an AI-generated response.

YOU ACKNOWLEDGE AND AGREE THAT:

• AI-generated information may contain errors or inaccuracies
• Nutritional data may be incomplete or outdated
• Ratings and scores are estimates, not definitive assessments
• Individual dietary needs vary significantly
• The app cannot account for all personal health factors
• Information should be verified with authoritative sources for critical decisions
• AI output may not be unique to you, and similar output may be generated for other users

We continuously work to improve accuracy but cannot guarantee error-free content.

Medication & Drug Interactions

Yemmi does NOT provide information about drug interactions.

If you are taking medications:

• Consult your pharmacist or doctor about food-drug interactions
• Do not rely on this app for medication-related dietary decisions
• Report any adverse reactions to your healthcare provider immediately

Pregnancy & Breastfeeding

If you are pregnant, planning to become pregnant, or breastfeeding:

• Consult your OB-GYN or healthcare provider before making dietary changes
• Do not rely on this app for pregnancy-safe food decisions
• Nutritional needs vary significantly during pregnancy and lactation
• Always follow your healthcare provider's specific recommendations

Children & Special Populations

For children, elderly individuals, or those with special health conditions:

• Consult appropriate healthcare providers before dietary changes
• Nutritional needs vary by age, condition, and individual factors
• This app is designed for general adult use
• Parental guidance recommended for users under 18

Allergies & Food Sensitivities

While Yemmi attempts to identify allergens:

• Always read actual product labels for allergen information
• Manufacturing processes can cause cross-contamination
• Ingredient formulations can change without notice
• When in doubt, contact the manufacturer directly

Do not rely solely on this app if you have severe allergies. Anaphylaxis and severe allergic reactions require immediate medical attention.

Health Conditions

If you have any health conditions (diabetes, heart disease, kidney disease, etc.):

• Work with your healthcare team for dietary guidance
• This app's suggestions may not be appropriate for your condition
• Medical nutrition therapy should be supervised by registered dietitians
• Regular monitoring and adjustment may be necessary

User Responsibilities

By using Yemmi, you agree to:

• Use the app lawfully and in accordance with these Terms
• Provide accurate information if you choose to create a health profile
• Not rely solely on Yemmi for medical or health decisions
• Consult healthcare professionals for medical advice
• Not misuse, reverse engineer, or attempt to hack the service
• Not use the app for any commercial purpose without permission
• Report any errors or issues you encounter
• Only upload content you have the right to submit and process through Yemmi
• Not upload private, sensitive, unlawful, infringing, or harmful content unrelated to food or nutrition analysis

You are responsible for maintaining the security of your device and data.

Privacy & Data

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key points:

• Health profile information is optional
• We do not sell your personal data
• You can delete your data at any time
• Yemmi uses third-party service providers for AI analysis, authentication, subscriptions, analytics, hosting, and optional crash diagnostics
• Using AI features means relevant scan and profile context may be shared with third-party AI providers, including OpenAI, to provide the requested analysis

Subscriptions & Payments

Yemmi offers both free and premium subscription options.

Free Features:

• Limited scans per day
• Basic nutritional analysis

Premium Subscription:

• Unlimited scans
• Enhanced AI analysis
• Priority support

Subscription terms:

• Some features may require an active paid subscription, and the app may use a hard paywall for premium access
• The current price, billing period, free-trial terms, if any, and renewal terms are shown before purchase
• Payment is charged to your Apple ID or the applicable app store account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account may be charged for renewal within 24 hours before the end of the current period
• You can manage or cancel subscriptions in your Apple ID or app store account settings
• Refunds are handled by Apple or the applicable app store according to their policies
• Prices and available plans may change with notice where required

Third-Party Services

Yemmi relies on third-party services to operate the app. These may include OpenAI for AI analysis, Supabase for authentication and data storage, RevenueCat for subscription entitlement management, Apple App Store / StoreKit for purchases, PostHog for product analytics, Cloudflare Pages for website hosting, cloud hosting providers for app infrastructure, and crash reporting providers if enabled.

Third-party services may process information as described in our Privacy Policy. We are not responsible for third-party services outside our control, but we choose providers that support our app functionality, security, and privacy commitments.

Intellectual Property

All content, features, and functionality of Yemmi are owned by Pluto Rock LLC and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute app content
• Use our trademarks without permission
• Create derivative works based on our service
• Use our content for commercial purposes

You retain ownership of personal data and content you provide. You grant us a limited license to process that content only as needed to operate Yemmi, provide the requested analysis, maintain safety and security, troubleshoot issues, comply with law, and improve our services as described in the Privacy Policy.

Disclaimers & Limitations

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim all warranties including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy of information
• Uninterrupted or error-free service

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits or data
• Personal injury or health outcomes
• Decisions made based on app information
• Third-party actions or services

Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.

Indemnification

You agree to indemnify and hold harmless Pluto Rock LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of Yemmi
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through the app

Termination

We may terminate or suspend your access to Yemmi at any time, without notice, for any reason, including breach of these Terms.

Upon termination:

• Your right to use the app ceases immediately
• You may request deletion of your data
• Provisions that by nature should survive will continue (disclaimers, limitations of liability, etc.)

How to Use Yemmi Responsibly

Yemmi is best used as:

• An educational tool to understand ingredients
• A starting point for nutritional awareness
• A way to discover products aligned with your preferences
• A complement to (not replacement for) professional guidance

Always combine app insights with:

• Professional medical advice
• Verified nutritional resources
• Your own research and judgment

Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes shall be resolved through:

• Informal negotiation (30 days)
• Binding arbitration (if negotiation fails)
• Arbitration conducted by AAA under Consumer Arbitration Rules

Class action waiver: You agree to resolve disputes individually and waive any right to participate in class actions.

Small claims: Either party may bring claims in small claims court if eligible.
